《劳动合同法》没有自离规定,《劳动法》第25条、《劳动合同法》第39条、第40条规定用人单位可单方解除劳动合同。
1.第三十九条劳动者有下列情形之一的,用人单位可以解除劳动合同:
(一)在试用期间被证明不符合录用条件的;
(二)严重违反用人单位的规章制度的;
(三)严重失职,营私舞弊,给用人单位造成重大损害的;
(四)劳动者同时与其他用人单位建立劳动关系,对完成本单位的工作任务造成严重影响,或者经用人单位提出,拒不改正的;
(五)因本法第二十六条第一款第一项规定的情形致使劳动合同无效的;
(六)被依法追究刑事责任的
就是你的行为如果符合此条第二款规定,单位就可以严重违反单位规章制度为由单方解除劳动合同,给你解除劳动合同通知,如果只是口头说你怎么怎么样就算自离,一直没有通知解除劳动合同,你们之间的劳动合同就是有效的。
2、关于旷工几天的规定,《劳动合同法》没有规定。
因旷工被除名的法律依据是:《企业职工奖惩条例》(国发[1982]59号)的规定,由用人单位提出与无正当理由旷工的职工终止劳动关系的一种处理方式。除名的条件是:(1)职工经常旷工没有正当理由;(2)经批评教育无效;(3)达到规定的旷工天数,即连续旷工时间超过15天,或者1年以内累计旷工时间超过30天。
但是注意此规章已经于20xx年1月15日,被国务院第516号令明文废止。如企业现行规章制度中仍规定“除名”或“开除”等相关条款,显然缺乏法律依据。
至于旷工几天单位可以解除劳动合同,单位可以制定单位内部管理制度,根据情况自己制定。
如果你单位没有员工手册规定旷工几天是严重违反单位制度,单位有权单方解除劳动合同,只是口头告诉你,本律师认为口头无效。如果没有“单位规章制度”,何以“严重违反单位规章制度”呢!
3、无故克扣你的工资没有法律依据。
